The primary focus of the firm’s practice is litigating and resolving disputes involving the transfer of wealth via trusts, estates and similar instruments, and related civil litigation.  We represent trustees, executors, administrators, conservators, other fiduciaries, beneficiaries, including charities, surviving family members, and other interested parties. We have vast experience in will contests, trust contests, disputes between fiduciaries and beneficiaries, enforcing and defending creditors’ claims, breach of contract, breach of promises to make testamentary dispositions, elder financial abuse, Marvin claims, ownership of real property interests, accounting disputes, and complex trust and probate administration disputes.

Philosophy

We prepare each case on the assumption that it will go to trial.  Nevertheless, our focus is on practical outcomes that align with the client’s needs.  We keep the client involved in analyzing the costs and benefits of any particular strategy.  We always consider alternative methods of dispute resolution, such as mediation.

Representation Model

The firm has established a successful practice of co-counseling with other law firms, small and large.  Because of his decades of involvement with State and local Trusts and Estates Bar Associations, Ciarán is able to draw on the expertise of highly-qualified colleagues up and down the State.  Sometimes this is done to obtain additional legal resources for a particularly large case.  Sometimes it is to obtain local counsel near a distant court, for efficiency reasons.  And sometimes it is to provide some specialized knowledge or experience that this highly complex area of the law may require.  The goal is to provide the client all of the benefits of small-firm representation, without compromising the level of expertise the client receives.
